Terms of Service

These terms apply when you use this website or buy a store setup service from EcomLaunch Solutions LLC. Your accepted quote plus these terms are the written agreement between us.
1. Who we are and these terms
EcomLaunch Solutions LLC (“EcomLaunch”, “we”, “us”) is a limited liability company registered in Montana, United States, with its office at 700 SW Higgins Ave Ste 111, Missoula, MT 59803, United States. You can reach us at support@ecomlaunchsolution.com or on WhatsApp at +91 96318 76584. These terms apply to this website and to every Shopify store setup service we sell. You accept them by ticking the box on our request form, by accepting a written quote, or by paying an invoice. You confirm that you are at least 18 years old and that you are ordering for a business or for your own business plans.
This page is written in English. If it is translated, the English version controls.
2. What we are not
We are an independent service provider. We are not Shopify and we do not work for Shopify. We use a free Shopify Partner account only so that we can ask for access to your store without asking for your password. We are not listed in Shopify’s Partner Directory, hold no Shopify badge, and Shopify has not reviewed, approved, sponsored or endorsed our services. Your Shopify account, subscription, billing and any support from Shopify are between you and Shopify Inc. under Shopify’s own terms.
3. Order of documents
If documents conflict, this is the order that applies: first your accepted written quote, then the package description on our Packages page on the date of your quote, then these terms, then our Refund Policy and Privacy Policy.
4. What we do
We set up and configure five areas of your Shopify store: your theme, your product pages and collections, your payment options, your shipping settings and basic SEO settings. Each package has fixed limits, shown on the Packages page and repeated in your quote: Essential Launch, Complete Launch and Catalog Launch differ in the number of products, collections, payment providers, shipping zones, apps, revision rounds and free-fix days included.
Unless your quote says otherwise, we do not provide: logo or brand design beyond the simple text logo add-on, product photography, writing product descriptions from scratch beyond the add-on, custom code or custom apps, moving a store from another platform, advertising and marketing, finding products or suppliers, running the store after launch, legal or tax advice, or approval by any payment provider. Anything extra is quoted in writing before we start it.
5. What you do
Send the items on our checklist within a reasonable time, and answer our questions during the project.
Own, or hold the rights to, everything you send us: your logo, photos, text, product data and brand.
Make sure that the products you sell, and the way you describe them, are legal where you sell them and allowed under Shopify’s rules.
Take responsibility for your own store policies, taxes, customer service and legal obligations to your customers.
6. Your store and our access
You open the Shopify store with your own email address and pay Shopify directly, so you are the store owner from day one. We send a collaborator request from our Shopify Partner account; you approve it in your Shopify admin and choose which areas we can use. You can remove our access at any time. We never ask for, and never accept, your password, two-step verification codes, or bank and payout logins. At handover, you remove our access or we confirm in writing that we have stopped using it. Your accepted quote together with these terms is the written agreement between us that covers this access.
7. Payment providers
You apply to payment providers in your own name and complete their identity checks yourself. Whether a provider approves you is the provider’s decision, not ours. We connect the providers you are approved for, add manual methods you choose, and place a test order. We never open payment or provider accounts in someone else’s name, and we never use a borrowed address or company to obtain a provider for you.
8. Third-party costs and licenses
Your Shopify plan, your domain, any paid theme or app, and all payment-provider fees are paid by you to those companies and are not part of our price. A paid theme is licensed to one store and its purchase is normally final, so we help you preview it before you buy. Prices, features and availability of third-party products can change without notice and are outside our control.
9. Timeline
Turnaround is 5 to 7 working days for Essential Launch, 10 to 12 for Complete Launch and 15 to 20 for Catalog Launch. The clock starts on Day 1: the first working day after your first payment has cleared and we have the required checklist items. Delays in sending items, answering questions or approving access pause the clock. If we have no reply from you for 14 days, the project is paused. If we have no reply for 60 days, the project is closed and what you paid is handled under the Refund Policy.
10. Revisions and changes
Essential Launch includes 1 revision round, Complete Launch 2 and Catalog Launch 3. A revision round is one written list of changes within the scope of your package. An extra round costs US$49. Anything outside the scope, such as new features or more products than your package includes, is quoted in writing before we do it.
11. Preview, acceptance and launch
When the setup is ready we send you a preview link. You have 7 days to send your change list or to approve the preview. If we hear nothing within 7 days, the preview counts as approved. The second payment is due before we connect your domain and launch the store.
12. Free-fix period
For 14 days after handover for Essential Launch, 30 days for Complete Launch and 45 days for Catalog Launch, we fix free of charge anything we set up that does not work as described in your quote. The free-fix period does not cover changes made by you or by someone else, problems caused by apps, themes or Shopify updates, or new work.
13. Fees and payment
Our prices are fixed amounts in US dollars: Essential Launch US$399, Complete Launch US$799 and Catalog Launch US$1,499, plus any add-ons you choose. You pay 50% before work starts and 50% after you have seen your finished store on the preview link. Invoices are issued by EcomLaunch Solutions LLC, and we accept payment only from you, not from third parties.
Ways to pay
ACH or international wire in US dollars, including through Wise where Wise serves your country.
USDT or USDC on the network named on your invoice.
Escrow.com, where Escrow.com serves your country.
Rules that apply to every payment
You pay your own bank, transfer, currency conversion, network and escrow fees, and the full invoiced amount must arrive.
For USDT or USDC, confirm the wallet address with us on WhatsApp before you send. Coins sent on a different network, in a different coin or to a different address than the invoice states may be lost and cannot be recovered by us.
We screen payments as US sanctions law requires and may decline or return a payment we cannot accept.
Please use a payment method that is allowed where you live. You are responsible for following the rules of your own country.
14. Escrow
If you choose Escrow.com, its own terms govern the money it holds. The two payment stages in your quote are the escrow milestones: Escrow.com releases the first half when work starts and the second half when you approve the preview. The escrow fee is paid by you and shown by Escrow.com before you pay. Escrow is available only where Escrow.com serves your country.
15. Taxes
Our prices do not include any tax we are required to charge. If a tax applies to your invoice, it is shown on the invoice. You are responsible for any tax, duty or withholding that applies in your own country, and for your own tax registrations.
16. Refunds
Refunds are handled under our Refund Policy at ecomlaunchsolution.com/refund-policy, which is part of these terms.
17. Payment disputes
If you think an invoice or a charge is wrong, contact us first at support@ecomlaunchsolution.com and we will resolve it with you directly. If you open a payment dispute with your bank, Escrow.com or another provider, work on your project pauses until the dispute is resolved.
18. Intellectual property
You keep all rights to your content, photos, product data and brand. Once you have paid in full, you may use everything we set up in your store without limit. Themes and apps stay under their owners’ licenses. We keep the rights to our own templates, checklists, methods and know-how, which we may reuse for other clients.
19. Showing your store
We show a client’s store on this website only with that client’s separate written permission, which the client can withdraw at any time by email.
20. Confidentiality and your customers’ data
We keep your business information confidential and use the data inside your store only to do the work you asked for. We do not keep copies of your customers’ data after the project. A data processing addendum is available on request for clients who need one.
21. No guarantees
We promise to set up your store with reasonable skill and care as described in your quote. We do not promise sales, traffic, search rankings, approval by any payment provider, or that Shopify’s features, prices or rules will stay the same.
22. Stores we won’t build
We do not set up stores for illegal, counterfeit or restricted products, or for anything that breaks Shopify’s Acceptable Use Policy. We may decline or stop a project for these reasons, and the Refund Policy then applies.
23. Sanctions
We cannot work with people, businesses or places that are subject to US sanctions. Today that includes businesses based in Cuba, Iran, North Korea and Syria, in the Crimea, Donetsk and Luhansk regions, and in Russia and Belarus, and anyone on a US government sanctions list. This list follows US law and can change. If we discover that a project falls under sanctions, we stop it and follow the law on what happens to any payment.
24. Liability
We provide our services with reasonable skill and care. To the extent the law allows, our total liability for all claims connected with a project is limited to the fees you paid us for that project, and we are not liable for lost profits, lost sales or indirect losses, or for outages or changes at Shopify, payment providers, theme or app developers, banks, wallets or Escrow.com. Nothing in these terms limits liability that cannot be limited by law.
25. Indemnity
You agree to cover us for claims and costs caused by your products, your content, your instructions, or your breach of these terms or of any law or of Shopify’s rules.
26. Ending the service
You can end a project at any time by email; the Refund Policy sets out what is refunded. We can end a project for non-payment, abuse of our team, illegal or restricted products, sanctions reasons, or if you do not reply for 60 days, as set out in section 9.
27. Events outside our control
Neither of us is responsible for delay or failure caused by events outside our reasonable control, such as outages at Shopify or other platforms, internet or power failures, natural disasters, government actions or similar events. Timelines extend for as long as the event lasts.
28. Governing law and disputes
These terms are governed by the laws of the State of Montana, United States. If a dispute arises, we first try to resolve it by email within 30 days of either of us raising it. If that fails, the dispute is decided by the state or federal courts located in Montana, unless the law of your country gives you the right to bring a claim where you live.
29. Consumer rights
Nothing in these terms removes rights that consumer protection law gives you and that cannot be waived. If you are a consumer in the European Union or the United Kingdom, you may have a 14-day right of withdrawal; by asking us to start work within that period you agree that the part of the service already delivered is paid for, as the Refund Policy explains.
30. General
Notices to us are sent by email to support@ecomlaunchsolution.com; notices to you are sent to the email address on your quote. If one part of these terms is found invalid, the rest stays in force. We may update these terms for future orders by posting a new version here with a new date; a project already quoted keeps the terms that applied on the date of the quote.
